Motorola made the decision to file suit after an investigation revealed that unsolicited e-mails sent to consumers misled them into believing that Motorola was affiliated with the Paging America offer. They contained Motorola trade marks and referred to free Motorola pagers that, in fact, were neither free nor made by Motorola. The lawsuit claims Paging America violated federal rules and regulations on unfair competition, deceptive trade practices, and also unsolicited e-mail statutes.
“This lawsuit reflects our desire to protect the value of the Motorola brand, and our commitment to the millions of consumers who purchase quality Motorola products”, stated Motorola Messaging Vice President Miguel Pellon. “We are dedicated to protecting our customers' rights as well as their privacy and we will not tolerate the undermining of our valuable brand”.
